What Are the Financial Penalties for Overweight Trucks in Illinois?

Financial Penalties for Trucking Weight Violations

In Illinois, a commercial truck driver may face weight restriction violations if:

  • The gross weight of the truck exceeds the maximum specified amount
  • There is too much weight on the axles

According to 625 ILCS 5/15-113, the driver of an overweight truck shall be fined based on the following schedule. If the truck is overweight by:

  • Up to and including 2000 pounds, the resulting fine is $100
  • 2001 pounds to 2500 pounds, the resulting fine is $270
  • 2501 pounds to 3000 pounds, the resulting fine is $330
  • 3001 pounds to 3500 pounds, the resulting fine is $520
  • 3501 pounds to 4000 pounds, the resulting fine is $600
  • 4001 pounds to 4500 pounds, the resulting fine is $850
  • 4501 pounds to 5000 pounds, the resulting fine is $950

For trucks that are overweight by 5001 pounds or more, the fine shall be $1500 for the first 5000 pounds overweight, and $150 for every additional 500 pounds over. Furthermore, a driver that is convicted of four or more violations within 12 months will be fined an additional $5000 for each conviction within the 12 month period.
